The Plainview City Council is reviewing a new ordinance to regulate the use of electric bicycles and scooters inside the City limits.
The first reading of the ordinance, No. 1026, was passed at the July 14 City Council meeting, and there will be two more readings to be heard at the next two City Council meetings for the public to comment on the ordinance rules.
The Ordinance defines the electric bicycles and scooters by wattage and speed – three classes of bicycles – 750 watts, when rider is not pedaling, at 20-28 miles per hour; a “scooter” is defined as a device weighing less than 100 pounds, with handlebars or motor to be stood or sat upon, and propelled without human power.
There is an authorized use – wherein they can be operated unless there is specific rules in the area against it, and as long as they are not traveling more than 35 miles per hour, except when crossing a street as described.
Operators are called to obey all traffic laws, signs and signals, and also yield to all pedestrians and vulnerable road users – with an audible warning before overtaking someone.
Head and tail lights are required for operating after daylight hours, and no person under 16 shall operate on any street or trail inside the City Limits; and all persons under 18 are required to wear a helmet.
Operators under 16 are not allowed to operate 30 minutes after sunset to sunrise; 16-17 year olds are held to 10 p.m. to sunrise; unless they are accompanied by an adult.
There are also rules about impounding and other assorted rules involving use of cell phones while driving, passengers and reckless operation.
